İspat yükü, hâkimin kanaate varamadığı durumlarda, belirsizlik halinin aşılabilmesini sağlayan hukuki bir kurumdur. Bir vakıaya dayanarak hak talep eden taraf, o vakıayı ispatla yükümlüdür. İlgili düzenleme menfi vakıalar için de geçerlidir.
Menfi vakıaların ispatının müspet vakıalara kıyasla her zaman daha zor olduğu iddia edilemez. Genel olarak menfi vakıaların ispatı zor olmakla birlikte çoğu zaman imkân dâhilindedir. İspatı gereken hususların belirlenebilir veya sayılabilir olmadığı belirsiz menfi vakıaların ispatı çok zor olmasına rağmen, sonuçtan ya da sebepten hareketle ispatı mümkün olabilir. Ancak aksi durumun imkânsızlığı yoluyla belirsiz menfi vakıaların ispatlanması mümkün olmayacaktır.
Menfi vakıalarda ispat güçlüğünün aşılması için ispat ölçüsünün yaklaşık ispata çevrilmesi bir araçtır. İspattaki güçlüğün bertaraf edilmesi amacıyla iddiada bulunan tarafın karşısındaki tarafa, ispat yükü taşımasa dahi, hâkim kanalıyla somutlaştırma yükü yüklenmesi de somut olay adaletine hizmet edecektir.
The burden of proof is a legal institution that enables the elimination of uncertainty in situations where the judge is unable to reach a conviction. The party who asserts a right based on a particular fact is obliged to prove that fact. The relevant rule also applies to negative averments.
It cannot be claimed that the proof of negative averments is always more difficult than the proof of positive facts. Although the proof of negative averments is generally difficult, it is often possible. Even though proving indeterminate negative averments—where the matters to be proven are neither identifiable nor enumerable—is highly difficult, such averments may nevertheless be established by reasoning from the result or from the cause. However, proving indeterminate negative averments through the impossibility of the contrary is not possible.
In order to overcome evidentiary difficulties in cases involving negative averments, lowering the standard of proof to a prima facie proof constitutes an important instrument. Furthermore, for the purpose of eliminating difficulties in proof, imposing—through the judge—a duty of concretization on the opposing party, even where that party does not bear the burden of proof, would serve the justice of the individual case.
